تبیین نقش پلیس ترمیمی در شرمساری پیشگیرانه از تکرار جرم |

زمینه و هدف: یکی از مشکلات جوامع امروزی افزایش پدیده بزهکاری و تکرار آن می‌باشد. یکی از سازمان‌های مهم در زمینه مبارزه با بزهکاری، سازمان پلیس است. پلیس به دلیل برخورد اولیه با بزهکاران در زمینه پیشگیری از تکرار بزهکاری می‌تواند نقش بسزایی ایفا کند. یکی از اقدامات پلیس در این راستا، استفاده از برنامه پلیس ترمیمی است. پلیس ترمیمی برنامه‌ای است که در اختیار پلیس جامعه‌محور قرار می‌گیرد تا از طریق عملکرد خاص خود، بتواند به پیشگیری از تکرار جرایم بپردازد. لذا با توجه به این که پژوهش‌هایی در مورد پلیس جامعه‌محور انجام گرفته اما پژوهشی در زمینه پلیس ترمیمی صورت نگرفته در این پژوهش به این موضوع پرداخته شده است. روش‌شناسی: این پژوهش از نظر هدف، کاربردی و از نظر شیوه اجرا توصیفی-تحلیلی است. داده‌ها به شیوه اسنادی و کتابخانه‌ای از کتاب‌ها، مقاله‌ها و ترجمه‌ها استخراج و مورد تجزیه و تحلیل قرار گرفته است. یافته‌ها و نتایج: نتایج حاصل از تحقیق نشان می‌دهد که پلیس سنتی با اقدامات سرکوب‌گرانه خود در تأمین هدف مبارزه با جرایم موفق عمل نکرده است. بدین معنا که اقدامات انجام گرفته توسط پلیس و سیستم رسمی رسیدگی، برچسب مجرمانه‌ای به بزهکار الصاق می‌کند که اصلاح و بازگشت وی به جامعه را با مشکل روبه‌رو می‌کند در نتیجه، این امر منجر به تکرار جرایم می‌گردد. در حالی که پلیس، در رویکرد جدید جامعه‌محوری خود از مشارکت مردم در تأمین نظم و امنیت و مبارزه با جرایم استفاده می‌کند. در این راستا برنامه جدیدی به نام پلیس ترمیمی به پلیس جامعه‌محور ارائه می‌شود در این برنامه پلیس با استفاده از روش‌های ترمیمی مانند میانجیگری و نشست و با مشارکت جامعه، بزهکار و بزه‌دیده را در کنار هم قرار می‌دهد تا از طریق مسئولیت‌پذیری و ایجاد شرمساری بازپذیرکننده در بزهکار از تکرار جرایم پیشگیری کند. |

Explaining the Role of Restorative Police in Preventive Shamefulness of Recidivism |

Background and objectives: One of the problems of today's societies is an increase in the phenomenon of delinquency and crime repetition. One of the key organizations in the fight against crime is the police organization. Police can play a significant role in preventing crime repetition due to the initial dealings with criminals. One of the police actions in this regard is the use of a restorative policing program. The restorative policing is a program that is being made available to the community policing to help them prevent crime repetition through their own specific functions. Therefore, considering that some studies on community policing have been carried out, and no research has been conducted on restorative policing, this study has addressed this issue. Methodology: In terms of its objectives this study is of an applied research type and in terms of methodology it is a descriptive-analytical study. The data were collected and extracted from books, articles and translations using a documentary method and library study and then analyzed. Findings and Results: The results of the research show that the traditional policing have not succeeded in fighting against crimes through its repressive measures. In this sense, the police and the official investigation system attach the label of a criminal offender to the criminals that makes the offender's correction and return to the society difficulty. As a result, this leads to crime repetition. While the police, in their new community-based approach, use people's participation in order and security and fighting against crime. In this regard, a new program called a restorative policing is provided to the community policing. In this program, the police gather the delinquent and the victim together to prevent crime repetition by means of restoration methods, such as mediation and social gatherings, and bringing responsibility and creating a retributive shame in the offender. |
