عنوان فارسی تأثیر زندان در پیشگیری از تکرار جرم و نقش آن در اصلاح و بازپروری مجرمین با تاکید بر مجرمان خطرناک در سیاست جنایی تقنینی ایران
چکیده فارسی مقاله زمینه و هدف: سیاست جنایی تقنینی ایران در قبال زندان و نقش آن در اصلاح و بازپروری مجرمین خطرناک موضوع مقاله پیش رو می باشد. در نظام حقوقی ایران به تاثیر از اسناد فراملی حقوق بشری موضوع اصلاح و بازپروری مجرمین و از جمله مجرمین خطرناک از پیش از انقلاب تا به امروز دستخوش تحولاتی شده که منجر به انسانی شدن و تعالی حقوق مجرمین شده است. نظام سنتی اصلاح و بازپروری تنها از طریق اعمال مجازات پیشگیری و درمان را توصیه می نمود ولی در یافته های نوین جرم شناسی بحث بازگشت مجدد مجرمین به جامعه مطرح شده است.
روش: در این پژوهش نگارنده به شیوه توصیفی تحلیلی به تشریح موضوع اشاره داشته است.
یافته ها و نتایج: اگرچه تحت تاثیر سیاست های تقنینی و قضایی و اجرایی سخت گیرانه که در دهه نود میلادی در غرب به پارادایم رایج نظام عدالت کیفری تبدیل شد، سخت گیری و عدم بازگشت به جامعه را علت وجودی و نقطه ثقل نظام سیاست جنایی قرار داده بود، اما با شکست این اندیشه تحت تاثیر دیدگاه های نوین حقوق بشری در راستای اصلاح و بازپروری مجرمین قوانین داخلی کشورها نیز دچار تحولی شگرف شد. تحت تاثیر قوانین فراملی دیگر در نسل دوم حقوق بشر کرامت انسانی و احترام به حقوق زندانیان در راس هرم نظام عدالت کیفری قرار گرفت و باعث انسانی شدن دیدگاه و عمل در راستای حمایت از حقوق زندانیان گردید.

عنوان انگلیسی The effect of prison in preventing the recurrence of crime and its role in correcting and rehabilitating offenders Emphasizing on dangerous criminals in Iran's legislative criminal policy
چکیده انگلیسی مقاله Background and Aim: Iran's legislative criminal policy towards prisons and its role in the correction and rehabilitation of dangerous criminals is the subject of this article. In the Iranian legal system, under the influence of transnational human rights documents, the issue of reform and rehabilitation of criminals, including dangerous criminals, has undergone changes from before the revolution until today, which have led to the humanization and excellence of criminals' rights. The traditional system of correction and rehabilitation recommended prevention and treatment only through the imposition of punishment, but new criminological findings have raised the issue of the return of criminals to society.
Method: In this research, the author has described the subject in a descriptive-analytical manner.
Findings and Results: Although under the influence of strict legislative, judicial and executive policies that became a common paradigm of the criminal justice system in the West in the nineties, strictness and non-return to society are the reason for the existence and focus of the criminal policy system. But with the defeat of this idea, under the influence of new perspectives on human rights in order to reform and rehabilitate offenders, the domestic laws of countries also underwent a dramatic change. Influenced by other transnational laws in the second generation of human rights, human dignity and respect for the rights of prisoners at the top of the pyramid of the criminal justice system and humanized the view and action to protect the rights of prisoners.
