زمینه و هدف: مسئولیت کیفری قابلیت یا اهلیت شخص برای تحمل تبعات جزایی رفتار مجرمانه‌ی خود است. این مهم در مجرمان یقه‌سرخ اگرچه واجد برخی اختلالات روانی ِ نا‌مؤثر در شکل‌گیری رکن معنوی جنایات علیه اشخاص هستند؛ اما همچنان در ایشان مناط اعتبار است؛ بنابراین ازآنجاکه برای خاموش نمودن صدای افرادی که در مسیر افشاسازیِ جرائم اقتصادی یا متقلبانه‌ی آنها قرارگرفته‌اند، قتل‌های ارتکابی خود را با برنامه‌ریزی پیشین اجرا می‌نمایند، جنایات آنها عمدی قلمداد می‌شود.
روش‌شناسی: نگارنده با روش توصیفی- تحلیلی به تبیین مسئولیت کیفری یقه‌سرخ‌ها در جنایت علیه اشخاص و تأثیر این مهم در نظام عدالت کیفری پرداخته است.
یافته‌ها و نتایج: یقه‌سرخ‌ها با خشونت ابزاری، آماج جرائم خود را با بی‌رحمی هرچه تمام‌تر به مباشرت، تسبیب یا معاونت هدف قرار می‌دهند و به‌رغم برخورداری از اختلال‌های روانی، توان تمییز و تفکیک افعالِ مختلف خود را داشته و قوه‌ی ادراک و توان ذهنی آنها دستخوش تغییر و انحراف نشده و اختلال عملکرد ذهنی فرد را موجب نمی‌شود. به‌عبارت‌دیگر یقه‌سرخ‌ها هنجارهای قانونی و اجتماعی را به‌خوبی درک می‌کنند و به ماهیت رفتار ارتکابی خود واقف‌اند و با آنکه رابطه‌ی اختلال شخصیتی با بزهکاری یقه‌سرخ‌ها به اثبات رسیده است، مع‌الوصف در مسئولیت کیفری این افراد تردیدی وجود ندارد؛ زیرا روان آزاری، خودشیفتگی و شخصیت ضداجتماعی آنها آن‌گونه نیست که ارتباط ایشان را با دنیای خارج قطع کرده و آنها را فاقد اراده و اختیار سازد. |

Criminal Responsibility of the Red Collared in Committing Crimes against People |

Field and Aims: Criminal responsibility is an individual’s capability or duty to bear the penal consequences of one’s criminal behavior. Although this issue comprises certain ineffectine psychological disorders in the formation of the spiritual pillar of crimes against people in the Red Collared criminals, it is still credible in them, therefore in order to silence those who are in the course of disclosing their economic or fraudulent crimes, these criminals commit their murderes in a premeditated manner and their crimes are considered intentional homicide.
Methodology: The writer has attempted to explain the responsibility of the Red Collared in committing crimes against people and the impact of this issue in the Criminal Justice System using a descriptive-analytical method.
Findings and Conclusions: The Red Collared commit their crimes with utmost instrumental cruelty with the help of an accomplice and regardless of having psychological disorders, they are able to distinguish and separate their different actions and their understanding and mental power are not affected by change and deviation and will not disrupt the individual’s mental functions. In other words, the Red Collared understand the legal and social norms well and are aware of their criminal behavior and though personality disorder behavior with the Red Collered delinquency has been proved, there is no doubt in these individuals’s criminal responsibility, because their psychological persecution, narcicism and sociopath attitudes are not in a way that their relationship with the outside world is disconnected and it does not render them to be will–free and determination- free. |
