زمینه و هدف: یکی از موضوعاتی که در سلامت محیط زیست وجود دارد جمع آوری و امحاء و دفن پسماندهای پزشکی است که در صورت اقدامات نادرست می‌تواند به و یکی از معضلات جدی زیست محیطی شهری تبدیل شود، از این رو شهرداری ها به عنوان یک موسسه حقوق عمومی غیر دولتی در انجام وظایف خدمات رسانی به مردم ممکن است در این زمینه منجر به برخی خسارت ها شود و لذا اصل عدالت خواهی ایجاب می‌کند که اشخاص اعم از حقوقی و حقیقی در مقابل رفتار خود، دارای مسئولیت مدنی و کیفری باشند.
روش: پژوهش حاضر به روش توصیفی و تحلیلی انجام شده است.
یافته ها و نتایج: در مسئولیت مدنی شهرداری در قبال مخاطرات زیست محیطی شهری ناشی از پسماندهای پزشکی در تقصیر شخصی، کارمند شهرداری از مال خود مکلف به جبران خسارت است و در خطای اداری حکم به مسوولیت شهرداری می شود و به هنگامی که خسارت حاصل تقصیر شخصی و خطای اداری باشد قاعده تضامن اداری کارمند نیز موجب مسوولیت شود ضمن این که با نگاهی به ماده 2 آیین نامه اجرایی قانون مدیریت پسماندها، ارگان های نیز در این امر دخیل بوده و در تعیین ابعاد مسئولیت مدنی شهرداری ها باید تقصیر سایر ارگان ها با موضوع پسماندها در نیز جهت ارزیابی بهتر در نظر گرفت، در مسئولیت کیفری شهرداری، ایجاد رابطۀ استناد میان رفتار ارتکابی و مخاطرات زیست محیطی شهری با اقدام شهرداری و وجود ارکان مسئولیت کیفری اشخاص حقوقی شرط تحقق است. |

Method: The present research was carried out using a descriptive and analytical method.
Findings and results: In the civil responsibility of the municipality for urban environmental hazards caused by medical waste due to personal fault, the employee of the municipality is obliged to compensate the damage from his own property, and in the case of administrative error, the municipality is held responsible, and when the damage is caused by the fault If it is personal and an administrative error, the rule of administrative solidarity of the employee will also cause responsibility, while looking at Article 2 of the Executive Regulations of the Waste Management Law, the organs are also involved in this matter, and in determining the dimensions of civil responsibility of the municipalities, the fault of other organs should be The issue of wastes was also considered for a better evaluation, in the criminal responsibility of the municipality, |
