بررسی تأثیر مؤلفه‌های قانون در پیشگیری از فساد مالی کارکنان |

زمینه و هدف: نظر به اهمیت پیشگیری از فساد مالی کارکنان، از بدو پیروزی انقلاب اسلامی تاکنون اقدام‌های متعددی در زمینه جرم‌انگاری مصادیق فساد مالی کارکنان به‌عمل آمده است. برهمین اساس هدف از نگارش این مقاله، تبیین و بررسی تأثیر مؤلفه‌های قانون در پیشگیری از فساد مالی کارکنان است.
روش‌شناسی: این تحقیق را بر مبنای هدف، از نوع کاربردی و بر مبنای ماهیت و روش، از نوع توصیفی تحلیلی با استناد به مطالعه منابع کتابخانه‌ای، اسنادی و جمع‌آوری اطلاعات مربوط به پیشینه و ادبیات تحقیق است.
یافته‌ها و نتیجه‌گیری: یافته‌های تحقیق نشان می‌دهد که توجه به مؤلفه‌های پیشگیرانه از جمله آشنایی کارکنان با قوانین و مقررات ناظر بر پیشگیری از فساد مالی «قانون اساسی» و قوانین عادی «قوانین تصویب‌شده در مجلس شورای اسلامی» و اصلاح یا حذف مصوبات و قوانین غیرضرور، افزایش سامانه‌های فنّاوری ارتباطات و اطلاعات در ارائه خدمات اداری، حمایت از مشارکت مردم و نهادهای مدنی در امر گزارش فساد مالی کارکنان، بی‌شک کاهش فساد مالی را در پی خواهد داشت.
نتایج حاصل از این تحقیق نشان می‌دهد که مؤلفه‌های مؤثر قوانین و مقررات در پیشگیری از فساد مالی کارکنان، در نظام حقوقی و قانونی ایران نهفته شده است باوجود مراجع متعدد قانون‌گذاری و کثرت قوانین در زمینه‌های مختلف از جمله مقابله با فساد مالی کارکنان، به‌لحاظ فقدان منطق و انسجام لازم در قوانین و تعارض و هم‌پوشانی آن‌ها مقابله با پدیده فساد نه‌تنها موفقیت‌آمیز نبوده بلکه تورم قوانین و کثرت مراجع وضع قانون، خود از اسباب بروز فساد مالی است.

Background and purpose: due to the importance of preventing employees' financial corruption (intelligence), since the victory of the Islamic Revolution, many measures have been taken in the field of criminalizing cases of employee financial corruption. Based on this, the purpose of writing this article is to explain and examine the effect of the law's components in the prevention of financial corruption of (intelligence) employees.
Methodology: This research is based on the purpose, applied type and based on the nature and method, descriptive and analytical based on the study of library sources, documents and collecting information related to the background and literature of the research.
Findings and conclusions: The findings of the research show that paying attention to the preventive components, including the familiarization of the employees (intelligence) with the laws and regulations regarding the prevention of financial corruption "Constitution" and ordinary laws "Laws approved in the Islamic Parliament" and amending or removing the approvals And unnecessary laws, increasing communication and information technology systems in the provision of administrative services, supporting the participation of people and civil institutions in the matter of reporting employee financial corruption, will undoubtedly lead to the reduction of financial corruption.The results of this research show that the effective components of laws and regulations in preventing financial corruption of employees (intelligence) are hidden in the legal and legal system of Iran, despite the numerous legislative authorities and the plurality of laws in various fields, including dealing with employee financial corruption. Due to the lack of necessary logic and coherence in the laws and their conflict and overlapping, dealing with the phenomenon of corruption has not only been unsuccessful, but the inflation of laws and the plurality of law-making authorities is itself one of the causes of financial corruption. |
