عنوان فارسی واکاوی ضابطیت جامعه اطلاعاتی در سیاست جنایی تقنینی ایران
چکیده فارسی مقاله زمینه و هدف: ضابطان دادگستری با دسته‌بندی مختلف در متون قانونی و مقررات، به‌عنوان نهاد کشف جرم، در برقراری نظم عمومی و امنیت و همچنین فرایند رسیدگی به جرم از زمان وقوع و حتی قبل از وقوع جرم تا مرحله اجرای حکم، نقش مهم و بسزایی ایفا می‌کنند. بخش مهمی از آنان را مأموران جامعه اطلاعاتی تشکیل می‌دهند. در همین راستا، تحقیق حاضر با هدف شناسایی نقش ضابطیت جامعه اطلاعاتی و ظرفیت‌های قانونی آنان در سیاست جنایی تقنینی ایران انجام ‌شده است.
روش‌شناسی: پژوهش حاضر بر اساس روش توصیفی-تحلیلی و بر پایه اسناد و منابع کتابخانه‌ای نگاشته شده است. در این راستا با مطالعه قوانین داخلی و دیدگاه‌های مشورتی معاونت حقوقی قوه قضاییه و مقررات مرتبط با ضابطان، داده‌های به‌دست ‌آمده مورد تجزیه ‌و تحلیل قرار گرفته است.
یافته‌ها و نتیجه‌گیری: یافته‌های تحقیق نشان داد سیاست جنایی تقنینی ایران شامل قوانین، آیین‌نامه‌ها و سایر اسناد موجود الزام‌آور، به مقوله ضابطیت جامعه اطلاعاتی به‌صورت پراکنده پرداخته و در آخرین تقسیمات، ضابطان دادگستری را به سه‌شاخه عام، خاص و نظامی دسته‌بندی کرده است. جامعه اطلاعاتی در سیاست جنایی ایران و در متون قانونی و مقررات موجود در زمره ضابطان عام، خاص و نظامی تلقی و در یک اقدام جدید، عنوان ضابط امنیتی برای آنان تعیین‌شده است. نقش بی‌بدیل جامعه اطلاعاتی در فرایند کشف و رسیدگی به جرائم، توجه ویژه قانون‌گذار را در ساماندهی افتراقی این ظرفیت مهم در امور امنیتی و سیاست جنایی می‌طلبد.

چکیده انگلیسی مقاله Background and purpose: the existing security organization in FARAJA, using its intelligence and operational capabilities, must Background and purpose: Law enforcement agents with different categories in legal texts and regulations, as a crime detection institution, play an important and significant role in establishing public order and security as well as the process of dealing with the crime from the time of occurrence and even before the occurrence of the crime until the execution of the sentence. They perform an important part of them are the agents of the intelligence community. In this regard, the present research was conducted with the aim of identifying the role of law enforcement of the intelligence community and their legal capacities in the legal criminal policy of Iran.
Methodology: The present research was written based on the descriptive-analytical method and on the basis of library documents and sources. In this regard, the obtained data has been analyzed by studying the internal laws and the advisory views of the legal assistant of the judiciary and the regulations related to the Law enforcement agents.
Findings and Conclusion: The findings of the research showed that Iran's legislative criminal policy, including laws, regulations and other existing binding documents, addressed the category of law enforcement of the Intelligence society in a scattered manner, and in the latest divisions, it has categorized the Law enforcement agents into three general, special and military branches. Intelligence community in Iran's criminal policy and in existing legal texts and regulations are considered as general, special and military officers, and in a new measure, the title of security officer has been determined for them. The irreplaceable role of the intelligence community in the process of discovering and dealing with crimes requires the special attention of the legislator in the differential organization of this important capacity in security affairs and criminal policy.
