عنوان فارسی استانداردهای دادرسی عادلانه در فرآیند تحقیقات پلیسی در پرتو اسناد بین المللی حقوق بشر
چکیده فارسی مقاله تحقیقات پلیسی، حساس ترین مرحله از فرایند کیفری است؛ زیرا اولین مواجهه متهم با دستگاه عدالت کیفری در این مرحله انجام می شود. لذا توجه به اصول دادرسی عادلانه دراین مرحله از اهمیت بسیاری برخوردار است. برخی از این استانداردها با قدرت الزام آورکامل از قبیل اصل برائت دارای قدمتی طولانی هستند؛ اما برخی دیگر، نظیر لزوم اطلاع رسانی به متهم وخانواده وی، اعلام حق داشتن وکیل، علیرغم تصریح در اسناد بین المللی حقوق بشر، لیکن در قوانین کیفری کشورها چندان مورد توجه مقنن نبوده اند.هدف از این پژوهش تبیین استانداردهای دادرسی عادلانه در فرایند تحقیقات پلیسی بوده است.این پژوهش به روش اسنادی و کنابخانه ای از منابع موجود جمع آوری شده تااسناد بین المللی حقوق بشر و برخی از قوانین شکلی و ماهوی ناظر بر حقوق متهم در فرایند تحقیقات پلیسی را مورد بررسی قرار دهد. نتایج حاکی از آن است که استانداردهای جهانی حقوق بشر ناظر بر حقوق متهم در قوانین اساسی و عادی اکثر کشورها ازجمله کشورخودمان، تا حدودی مورد توجه قرار گرفته است. لیکن در برخی از موارد وظایف و اختیارات پلیس درفرایند تحقیقات پلیسی تبیین نشده است که البته در لایحه جدید با ذکر مواردی از قبیل اعلام حقوق متهم توسط پلیس و مراجع ذیربط، وظایف آنان تا حدودی نسبت به متون قانونی گذشته شفاف تر شده است. دراین راستا پیشنهادهایی از قبیل رفع خلاءهای قانونی و پیش بینی سازوکارهای نظارتی وتقنینی مستقل برای نظارت برعملکرد پلیس از قبیل سازوکارهای رویت پذیر ساختن اقدامات پلیس، توسعه وگسترش محدوده عملکرد ونظارت قضایی نسبت به عملکرد پلیس، تعامل هر چه بیشتر پلیس با نهادهای بین المللی حقوق بشر، آموزش حقوق بشر به منظور ارتقای دانش پلیسی ارایه شده است.

چکیده انگلیسی مقاله Police investigations are the most sensitive stage of the criminal process; Because the first encounter of the accused with the criminal justice system takes place at this stage. Therefore, paying attention to the principles of fair trial is very important at this stage. Some of these standards have a long history of binding force, such as the principle of innocence; But others, such as the need to inform the accused and his family, to declare the right to a lawyer, despite the stipulation in international human rights instruments, but in the criminal law of countries have not been given much attention by the legislature. The purpose of this study is to explain fair trial standards The investigation was conducted using documentary and canonical methods collected from available sources to examine international human rights documents and some formal and substantive laws governing the rights of the accused in the police investigation process. The results indicate that the international human rights standards governing the rights of the accused are somewhat taken into account in the constitutions and ordinary constitutions of most countries, including our own. However, in some cases, the duties and powers of the police have not been explained in the police investigation process. However, in the new bill, their duties have become somewhat clearer than in previous legal texts by mentioning cases such as the declaration of the accused's rights by the police and relevant authorities. In this regard, proposals such as eliminating legal loopholes and envisaging independent monitoring and legislative mechanisms to monitor police performance, such as mechanisms to make police actions visible, expand the scope of judicial action and oversight of police performance, police interaction with international human rights organizations. , Human rights education is provided to enhance police knowledge.
