غالب نظریه های سنتیِ کیفرشناختی، با پیش فرض قلمداد نمودن حق دولت بر مجازات کردن به جای توجیه کیفربه اهداف کیفردهی توجه و تلاش نمودند. وانگهی با ظهور و توسعه رویکردهای مبتنی بر اصلاح و درمان، حقوقکیفری با سوالات چالش برانگیزی مواجه شد: از جمله اینکه آیا اصلاح و درمان حق بزهکار است و اگر حق اوستچگونه با تکلیف دولت به مجازات کردن قابل جمع است، حقوق کیفری را با مفهوم حق بر مجازات نشدن و به تبعآن حق بر اصلاح و درمان آشنا نمود. مقاله پیش رو بر آن است تا با بررسی منابع مهم حقوق بشری قواعدی راشناسایی نماید که بتوان از آن ها برای صورت بندی حق بر مجازات نشدن استفاده نمود. ضمن آن که به شناساییآثار و نتایج حاصل از حق بر مجازات نشدن از قبیل حق محدودیت قانونی حقوق، حق دسترسی به عدالت، حقاختیاری اصلاح و درمان، حق بر رفتار عادلانه در پرتو عقلانیت و منع مجازات های غیر انسانی)حق اعمال کیفرهایترمیمی( پرداخته خواهد شد. |

Most of the traditional cognitive theories, with the presupposition of theright of the state to punish, instead of justifying the punishment, focusedon quadratic goals. Moreover, with the advent and development oftreatment-based approaches, criminal law faced challenging questions:including whether reforming and treating is a criminal offender, andif it is his right to combine with the government's task to punish, Theconcept of the right to non-punishment and, consequently, the right toreform and treatment. The paper seeks to identify rules that can be usedto formulate the right to non-punishment by reviewing important humanrights sources. In addition to identifying the effects and consequencesof the right to non-punishment, such as the right to legal restriction ofrights, the right to access to justice, the right to remedy and remedy, theright to fair treatment in the light of rationality and the prohibition ofinhuman punishment (the right to take corrective actions ) Will be paid. |
