پیشگیری از جرایم غیر عمد رانندگی با تاکید بر قانون بیمه اجباری خسارت وارده شده به شخص ثالث در اثر حوادث ناشی از وسایل نقلیه |

زمینه و هدف: تلفات ناشی از سوانح رانندگی و به تبع، خسارات بدنی و مالی سنگین ناشی از این گونه حوادث، موضوع را به معضلی ملی برای کشور تبدیل نموده است. این سوانح بیش از 7درصد از تولید ناخالص ملی را به خود اختصاص میدهد. ماحصل تلاش‌های صورت گرفته برای کنترل و مهار این معضل از بعد حمایت از زیان دیدگان حوادث رانندگی ، به صورت تصویب قانون اجباری خسارات وارد، شده به شخص ثالث در اثر حوادث ناشی از وسایل نقلیه تعیین و احصاء تکالیف و وظایف متنوع برای سازمانها و نهادهای متعدد دخیل در امر حوادث رانندگی متولد گردید. هدف این تحقیق پیشگیری از جرایم غیر عمد رانندگی با تاکید بر قانون مارالذکر میباشد.روش: تحقیق حاضر از نظر هدف کاربردی و از نظر روش به صورت توصیفی و تحلیلی میباشد. نویسنده در نظر دارد با تحلیل و بررسی مواد این قانون به احصاء شیوه های پیشگیری از جرایم غیر عمد رانندگی بپردازد.یافتهها و نتایج: کمبود ابزارهای پیشگیرانه موجود در قانون به عنوان نمونه محوریت خصوصیات وسیله نقلیه در تعیین حق بیمه نامه شخص ثالث. وعدم وجود نهادی فرادستی واجد اختیارات لازم به منظور نظارت بر حسن اجرای تکالیف تبیینی در قانون توسط نهاد های مجری قانون و ضرورت لحاظ ویژگی های فردی به استناد تبصره 1 ماده 18 قانون راننده و مکان جغرافیایی رانندگی در محاسبه حق بیمه و ضرورت پیش بینی مرجعی فرادستی در نظارت بر اجرای قانون توسط دستگاه های مجری ایجاد سامانه جامع حوادث رانندگی باستناد ماده 41 این قانون و توجه ویژه سازمانها بشرح وظایف خود در قانون مذکور برای پیشگیری از سوانح از موارد پیشنهادی و موارد اصلاحی و بازنگری در قانون است |

The Prevention of Unintentional Driving Offenses with an Emphasis on the Law of Compulsory Insurance of Damage Posed to the Third Parties Due to Accidents Caused by Vehicles |

Background and objectives: The casualties resulting from road accidents and, consequently, the physical and financial losses caused by such incidents have turned the issue into a national issue for the country. These accidents account for more than 7% of gross national product. The efforts made to control and mitigate this dilemma in protecting road traffic accident victims was determined as adopting the mandatory and compulsory law for damages caused to third parties due to accidents caused by vehicles and the roles and responsibilities for various organizations and institutions involved in driving accidents were emerged. The purpose of this study is to prevent unintentional driving crimes with an emphasis on abovementioned law.Methodology: In terms of its objectives this study is of an applied research type and in terms of its procedure, it is considered as a descriptive-analytic study. The author intends to address the extraction of preventing ways of unintentional driving offenses by analyzing and reviewing the provisions of this law.Findings and results: The lack of preventive tools in the law, as an example of the focus on the characteristics of the vehicle in determining third-party insurance premiums, and the absence of an superior institutional entity having the authority to monitor the good implementation of the explanatory assignments in the law by the law enforcement agencies and the necessity of considering the individual characteristics in accordance with Note 1 of Article 18 of the driver's law and driving location in calculating the premium and the necessity of a predicting superior reference in monitoring law enforcement by the agencies implementing the comprehensive system for driving accidents, based on the Article 41 of this law, and the special attention of organizations to their obligations in the aforementioned law for the prevention of accidents are the proposed cases and correctional subjects and amending items in the law. |
