چکیده فارسی مقاله توازن پایدار میان حفظ ارزش‌ها و انگاره‌های اجتماعی و نگارش قوانین کارآمد و بازدارنده بر این ضرورت تأکید دارد که روح جامعه‌ی انسانی باید در افق دید کارگزاران قوه مقننه قرار گیرد. این پژوهش از منظر اندیشه‌های امیل دورکیم به بررسی رابطه بین تقنین قوانین کیفری و قانون‌گریزی می‌پردازد. بی‌توجهی به وجدان جمعی در جرم‌انگاری، منجر به افزایش تورم کیفری و دل‌مشغولی هرچه‌تمام‌تر نظام عدالت جنایی است. از سوی دیگر، کاهش اقتدار قانون در برابر شهروندان و افزایش هزینه‌های جرم و کاهش امنیت عمومی از آثار سوء دیگر بی‌توجهی به خواست و اراده عمومی است. نتایج این مقاله بیان‌گر این است که بی‌اعتنایی به وجدان اجتماعی و تعلقات ارزشی افراد در عرصه قانون‌گذاری، نتیجه‌ای جز قانون‌گریزی شهروندان و ناکارآمدی قوانین و دل‌مشغولی بی‌فایده نظام عدالت جنایی را عرضه نداشته است؛ بنابراین کاهش تعامل روبه رشد نظام عدالت جنایی و افراد جامعه ایجاب می‌کند که نصوص قانونی را هرچه بیش‌تر بر پایه هنجارها و مطالبات واقعی جامعه برگزینیم با این هدف که بتوانیم ظرفیت قوانین را در راستای کنترل پدیده مجرمانه روزآمد و تقویت کنیم.

The results in this paper suggests the social conscience interests and allegiances indifference to the value of people in the bombing , but the rule of law as a result of citizens and inefficiency escape laws and andsped off the criminal justice system useless ; thus reducing their interaction growing criminal justice system and the people of the community , which requires legal by more than ever on the basis of norms and actual claims supposedly society with the objective of capacity in accordance with the laws, we can control and strengthen criminal phenomenon .
