اصلاح ساختارهای قانونی، نظارتی و فرهنگی در مبارزه با فساد اداری |

زمینه و هدف: فساد اداری که بستر آن، نظام اداری و اداره امور دولتی است، زمینه‌ای فراهم می‌کند که کارمندان فاسد از موقعیت انحصاری خود در ارائه خدمات به ارباب‌رجوع بهره می‌گیرند و با شغل خود به تجارت غیرقانونی می‌پردازند. روش تحقیق: این مقاله به روش توصیفی تحلیلی و با استفاده از منابع کتابخانه‌ای انجام‌شده است. یافته‌ها: در شرایط فساد اداری، کارمندان فاسد با سوءاستفاده از موقعیت شغلی ایجادشده، دست به اقداماتی می‌زنند که حقوق اجتماعی، اقتصادی و سیاسی شهروندان را نادیده می‌گیرند. اشکالات موجود ناشی از خلأهای قانونی، نبود سیستم‌های نظارتی قوی و سستی ساختارهای فرهنگی و اخلاقی جامعه، از عوامل زمینه‌ساز این وضعیت است. قانون‌گذار با تصویب قانون ارتقاء سلامت اداری و مقابله با فساد و دولت با تدوین و تصویب آیین‌نامه‌های مرتبط و فعال کردن دستگاه‌های نظارتی با همکاری قوه قضاییه، توانسته‌اند به اصلاح ساختار قوانین و کنترل بپردازند. جامعه نیز با تقویت ساختارهای فرهنگی و اخلاقی خود توانسته است در مرحله‌ی اول با از بین بردن زمینه‌ی فساد اداری و در مرحله‌ی بعد با نظارت و گزارش آن به مراجع ذی‌ربط در مبارزه با فساد اداری کمک زیادی کند. نتیجه‌گیری: فساد مالی، پدیده‌ای پیچیده است که با اصلاح ساختار قوانین، اصلاح کنترل و مسئولیت‌پذیری و اصلاح ساختار فرهنگی و اخلاقی جامعه از بین می‌رود. |

Setting and Purpose: Administrative corruption with the context of administrative system and managing government affairs, lays down the setting in which corrupt staffs take advantage of their own position to do services to clients and to do illegal business. Research method: This article has been conducted in descriptive and analytical method using library resources. Findings: In administrative corruption, corrupt staffs make their efforts to ignore social, economical and political rights of citizens considering their job position. The problems cased by legal gaps, lack of powerful supervisory systems and weakness of cultural and moral structures of society, are the factors paving the way for this situation. Legislator could modify the structure of rules and its control, by the approval the of the haw enhancing administrative flawlessness and combating corruption and government's codification and approval of the related procedures and activation of supervisory systems with cooperation of judicature. Society boosted its cultural and moral structures and consequently could first helped fighting administrative corruption a lot by preventing the setting for this corruption and next by supervising and reporting it to the qualified authorities. Conclusion: Administrative corruption is the complicated phenomenon that is eliminated by modifying law structure, control and accountability and cultural and moral structure. |
