تبیین مفاهیم جنایت علیه محیط زیست |

زمینه و هدف: دیرپایی است که زمین از جهانی شدن و جامعه صنعتی رنج می برد، رنجی که باعث انقراض گونه های مختلف و تغییرات آب و هوا و به خطر افتادت بقای نسل های آینده شده است. به رغم وجود چنین تهدیدی برای سرنوشت بشری، گام های کندی از سوی نهادها و سازمان‌های قانونی و بینالمللی برداشته شده است. گویی جامعه جهانی چشم به واقعیت تاسف بار فاجعه زیستمحیطی بسته است. اهداف اصلی این پژوهش، بررسی مفهوم جنایت زیستمحیطی در دامنه شمول جنایت علیه بشریت است یا در دامنه گسترده ای بعنوان یک جنایت مستقل. روش تحقیق: روش تحقیق حاضر بر اساس روش توصیفی- تحلیلی و بر پایه اسناد . منابع کتابخانه ای نگاشته شده است. یافته ها: نتایج پژوهش حاضر گویای این است که پس از جرم انگاری تخریب محیط‌زیست در اساسنامه دیوان بینالمللی کیفری و سایر اسناد بینالمللی، دولت ها و دیوان بینالمللی کیفری بیش از پیش ضمانت علیه محیط‌زیست را مورد شناسایی قرار داده اند. نتیجه گیری: روند تحولا حقوق محیط‌زیست بیانگر آن است که روز به روز بر اهمیت آن افزوده می شود و گفتمان های جدیدی در خصوص گنجاندن مفهوم جنایت زیستمحیطی در شمول جنایت علیه بشریت در اساسنامه دیوان بینالمللی کیفری مطرح شده است. |

Background and Objectives: The earth is suffering from globalization and industrial society, suffering from endangered species and climate change, and endangering the survival of future generations. Despite the existence of such a threat to human felonies, slow steps have been taken by international and international institutions and organizations as if the international community is blind to the reality of the ecological catastrophe. The main objectives of this study are to examine the concept of environmental crime within the scope of crime against humanity or to a large extent as an independent crime. Research of method: The research method is based on descriptive-analytical and document-based method. Library resources written. Findings: The results of this study indicate that, after the perpetration of environmental degradation in the Statute of the International Criminal Court and other international instruments, the governments and the International Criminal Court have more and more recognized the environmental guarantee. Conclusion: The evolution of environmental rights reflects the increasing importance of it every day and new discourses on integrating the concept of environmental crime into the crime of humanity have been raised in the Statute of the International Criminal Court. |
