قواعد حقوق بشر جایگاهی برتر از سایر قواعد حقوق بین الملل دارند، به طوری که حتی برای تعیین مشروعیت اقدامات در روابط بین الملل، رعایت حقوق بشر ملاک قرار می گیرد. دیوان دادگستری اروپا در قضیه کادی (2008) اولویت اجرای حقوق بشر را حتی بر الزامات ناشی از قطعنامه شورای امنیت سازمان ملل متحد که بر اساس فصل هفتم منشور ملل متحد صادر شده بود، مورد تائید قرار داد و بدین وسیله مشروعیت آئین نامه کمیسیون اروپا و قطعنامه شورای امنیت را زیر سوال برد. متعاقب این رای، شورای امنیت نیز با تغییر رویه خود در خصوص درج و حذف نام اشخاص در فهرست تحریم و ایجاد مکانیزمی جدید مبتنی بر امکان اعتراض آن ها به تصمیم کمیته تحریم، به نظر دیوان تمکین نمود. این نوشتار سعی دارد تا پس از تبیین جایگاه قواعد حقوق بشر در نظام حقوق بین الملل، رای دیوان لوکزامبورگ در قضیه کادی (2008) را از منظر برتری قواعد حقوق بشر مورد مداقه و بررسی قرار دهد. |

Priority of Implementation of Human Rights in the International Law with Emphasis on Kadi's Judgment (2008) in the European Court of Justice |

Human rights law has a higher status than other international law rules, so that human rights are based for the determination of the legitimacy of acts in international relations. The European Court of Justice in Kadi case (2008) endorsed the priority of implementation of human rights even on the treatments of the United Nations Security Council resolution which was issued under chapter VII of the United Nations Charter and undermined the legitimacy of the European Commission regulation and the Security Council resolution. Following this judgment, the Security Council also complained to The Court with changing practice in relation with listing and de-listing of persons in the sanctions list and to create a new mechanism based on possibility of protest to decision of the sanctions committee. This paper tries to examine the judgment of the Luxembourg Court in Kadi case (2008) in light of priority of human rights law after explaining the status of human rights in the international law. |
