عنوان فارسی اصول دادرسی عادلانه ناظر بر تحقیقات پلیس/ضابطان دادگستری
چکیده فارسی مقاله زمینه و هدف: مفاهیم دادرسی عادلانه در بردارنده جنبه کیفری موازین حقوق بشری است که در مقررات داخلی کشورها، ابتدا به صورت اصول راهبردی در قانون اساسی به آن توجه می شود و سپس تفصیل و شقوق آنها در قوانین و مقررات عادی ، ضمانت اجرادار و ضابطه مند می شود.ماهیت تکالیف و وظایف ضابطان دادگستری به گونه ای است که کارگزاران آن ، بیشترین تماس را با مردم پیدا می کنند؛ بنابراین طبیعی است که آنان بیشتراز سایر کنشگران عدالت کیفری در معرض نقض تضمین های حقوقی و قضایی مظنونان، متهمان، محکومان، بزه دیده، شهود و مطلعان و رعایت نکردن حقوق و آزادیهای مشروع و قانونی شهروندان باشند.از این رو ، نقض تشریفات دادرسی عادلانه نسبت به متهم و نیز رعایت نکردن الزامات رفتار منصفانه نسبت به بزه‌دیده و مطلعان گاه رسیدگی و حکم محکومیت کیفری را با ایرادهای شکلی روبه رو می سازد و گاه مرتکبان لطمه به کرامت انسانی متهم، بزه دیده و شهود را به اتهام نقض حقوق شهروندی در معرض تعقیب و محاکمه کیفری قرار می دهد. روش: روش مطالعه این مقاله مروری و با استفاده از منابع کتابخانه ای و تحلیل مطالب است که ضمن بررسی معیار های دادرسی عادلانه ناظر بر تحقیقات ضابطان دادگستری در اسناد بین المللی، ترجمان این معیار ها در قوانین داخلی ایران را ارزیابی می کنیم. یافته ها و نتایج: پیش بینی اصول دادرسی عادلانه در مواد نخستین ق.آ.د.ک. و تاکید مضاعف به اجرای آنها، مبین این واقعیت است که قانونگذار تضمین و پای‌بندی به این اصول را در صدر اهداف خود قرار داده، به این امید که ضابطان دادگستری نیز اصول دادرسی عادلانه و اجرای عملی آن را سر لوحه اقدامات خود قرار دهند.

چکیده انگلیسی مقاله Background and objectives: The concepts of fair trial involves criminal aspects of human rights that, first, are considered as guiding principles in the constitution in domestic regulations of countries, and then their details and alternatives in normal terms and enforcement guarantees are regulated. The nature of the law enforcers' tasks is in such a way that people find most contact with their agencies. Therefore, it is natural that they are more vulnerable to violations than other actors in the criminal justice and legal guarantees of suspects, defendants, convicts, victims, witnesses and informants and also not respecting the legitimate rights and freedoms of citizens. Thus, violations of fair trial due process to the accused person and failure to comply with the requirements of fair treatment with the victim and informants sometimes make formal objections when dealing with criminal conviction and sentence, and sometimes put the perpetrators of damage to the dignity of the accused person, victim and witnesses to the alleged violation of the rights of citizens at risk of prosecution and criminal trial. Methodology: This manuscript is a review study conducted using library resources and content analysis. By studying the basic fair trial standards governing Justice Research Officers in international documents, and translating these criteria we attempt to evaluate Iran's domestic law. Findings and results: In fact, the forecast of the principles of a fair trial in the primitive Code of Criminal Procedure and the emphasis on their implementation, reflects the fact that the legislator has placed the guarantees and adherence to these principles at the forefront of his objectives, hoping that law enforcers also place the principles of fair trial and practical application at panel of their actions
