گرچه اخیراً حقوق شهروندی در ادبیات حقوقی کشورمان مطرح شده است؛ لیکن دارای پیشینه ای بسیار طولانی است. بررسی فلسفه حقوق شهروندی به ما کمک می کند که با مبانی و چگونگی این شاخه از حقوق آشنا شده تا هم شهروندان جامعه بیش از پیش از این موضوع آگاهی یابند و هم مسئولان و کارگزاران حکومتی به ویژه مدیران نیروی انتظامی به لحاظ حساسیت شغلی مرتبط با حقوق شهروندان از قبیل: دستگیری متهم، تفهیم اتهام، توجه به اصل برائت و ... با جایگاه این مقوله آشنا شده و در جهت نهادینه شدن و حفظ آن اهتمام ورزند. هدف از این پژوهش تبیین فلسفه حقوق شهروندی در مدیریت پلیسی با تأکید بر منابع اسلامی است که در این مسیر تلاش شده، مبانی نظری و دیدگاه های تاریخی در این زمینه تشریح شود. این تحقیق از نظر هدف کاربردی و از لحاظ ماهیت و روش، توصیفی-تحلیلی است که داده های آن به صورت مطالعات اسنادی و کتابخانه ای یادداشت و تحلیل شده است. بررسی منابع اسلامی، نشان دهندۀ آن است که فلسفه حقوق شهروندی در مدیریت پلیسی، احقاق حقوق شهروندان ، رعایت عدالت ، انتظام بخشی به جامعه، برقراری تعادل بین مردم و حکومت و تعالی جامعه اسلامی می باشد. |

Altahough the Citizenship rights is recently in traduced in juridical literature of our country but it has a vary long history. Scrutizing the philosophy of the Citizenship Righs helps us to know the basics and circumstances of this branch of low in order for Citizens of the society to get familiar more than befor with this subject and orther hand for the people in position of authority especially the managers of police force because of the sensitivity of their job related with the Citizenship Righs such as Arresting defendan, charging some one with a crime, considering the innocence element ant … to know the place of this subject and to attempt to preserve it. The goal of this research is to state the philosophy of the Citizenship Righsin policing management with the emphasis on Islamic Sources that in this way we have attempted to expline the theoric principles and historical views of this field. This research is practical from the goal point of view and in the aspect on essence and method, it is descriptive- analytic that its data have been collected and analysed in the method of document study and library note-taking. Scrutinizing the Islamic Sources has shown that the philosophy of Citizenship Righs in policing management is to adjudicating the Citizenship Righs, serving the justice, bringing law and order to society, establishing the balance between people and the government and developing the Islamic society. |
